Terms & Conditions

These Terms of Use (“Terms”) govern your access to and use of an account (the “Account”) on the Swisper web application and related services (collectively, the “Service”) provided by Fintama AG, a company based in Zurich, Switzerland (“Company”). By accessing the Service you agree to be bound by these Terms. If you do not accept them, you must cease use immediately.

Definitions

  • Account: Your personal user profile created to access and use the Service.
  • Service: The Swisper web application and any related services provided by the Company.
  • Content:Any data or materials you submit (“Input”), and any data or materials generated in response (“Output”).
  • Company: Fintama AG, headquartered in Zurich, Switzerland.

Consumer Withdrawal Rights

EU/EEA consumers may withdraw within 14 days by emailing info@swisper.ai. However, if you request immediate service activation and begin using it meaningfully, you waive your right of withdrawal once the Service has been fully performed or when meaningful use has begun (such as interacting with the AI or generating Output).

Eligibility and User Requirements

The minimum age requirement is 16 years old. Users aged 16–18 must obtain parental or guardian consent, providing documentation upon request. The Company terminates accounts discovered to be operated by non-compliant minors. Service availability depends on jurisdiction legality.

Authorized Service Usage

Users must comply with these Terms to access their accounts. Prohibited activities include:

  • Disrupting company networks, servers, or services
  • Attempting unauthorized system access or hacking
  • Uploading, sharing, downloading, or accessing illegal content, including Child Sexual Abuse Material (CSAM)
  • Violating intellectual property rights
  • Engaging in harassment, discrimination, defamation, or threats based on gender, sexual orientation, religion, ethnicity, race, age, nationality, or disability
  • Promoting unlawful activities

Violating accounts face suspension or termination. Users must maintain credential confidentiality and report unauthorized access immediately.

Content Submission, Ownership, and Use

You retain ownership of your Input and own all Output rights. The Company assigns to you all rights, titles, and interests it may hold in the Output.

Due to the nature of artificial intelligence, Output may not be unique, and other users might receive similar content. The Company does not use your content for training or improvement purposes.

Output may be inaccurate, incomplete, or offensive and does not necessarily reflect the Company's views. Users bear sole responsibility for ensuring input and output comply with applicable laws, including data protection and export controls.

Company Intellectual Property Rights

The Company and its affiliates retain all rights, titles, and interests in and to the Service. Materials are owned or licensed, protected by copyright and trademark law.

Personal, non-commercial use only is permitted. Unauthorized use may result in account termination and legal action including injunctions, damages, and recovery of costs.

Use License

Permission is granted to temporarily use the Service for personal, non-commercial, transitory viewing only. Licensed users may not:

  • Modify or copy materials
  • Use materials commercially or publicly
  • Attempt reverse engineering of software
  • Remove copyright or proprietary notices

Disclaimers and Liability Limitations

The Service is provided “as is” without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

Liability is capped at the greater of: (a) fees paid in the preceding 12 months, or (b) CHF 100. Exceptions exist for death, personal injury, fraud, gross negligence, and willful misconduct.

Users must indemnify, defend, and hold harmless the Company and its affiliates from and against any third-party claims arising out of or related to their service use, term violations, or content they submit.

Privacy Policy

Accepting these Terms constitutes consent to the privacy policy. Users possess rights under EU GDPR and the Swiss Federal Act on Data Protection (FADP) to access, correct, delete, and restrict personal data processing.

Accessibility Commitment

The Company commits to accessibility conformance with WCAG 2.1 Level AA. Terms are provided in English with translations in EU/EEA markets where applicable. English versions prevail in translation conflicts.

Termination and Suspension

Either party may terminate agreements and accounts at any time. The Company may suspend or terminate immediately for term breaches or unlawful conduct. Upon termination, service access ends while intellectual property, liability, and confidentiality provisions survive.

Force Majeure

The Company shall not be liable for any failure or delay in performance due to events beyond its reasonable control, including natural disasters, acts of war, terrorism, pandemics, government actions, or labor disputes. Consumers who prepaid for undeliverable services due to force majeure events receive pro-rata refunds.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the substantive laws of Switzerland. Disputes resolve exclusively in Zurich courts.

Modifications to the Terms

The Company may update these Terms with publication on this page. We will provide at least 30 days' notice prior to any material changes. Continued use constitutes acceptance.

Miscellaneous

Invalid provisions do not invalidate remaining terms. These Terms constitute the entire agreement, superseding all prior agreements.
